Terms & Condition


In these terms and conditions "we", "our" and "us" means NZLVGOU (Company name: New Zealand Spring Tour Limited), "you" refers to the customer.

These terms and conditions together with your order constitute the entire contract between NZLVGOU and the customer. No other external terms and conditions are applicable to this website and business. Terms and conditions cannot be varied without prior approval from both parties in writing.

Acceptance of Terms and conditions


The terms and conditions are the terms on which NZLVGOU offers you access to the services of our website. By registering as a member with us, or purchasing products from us, you are accepting these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the services.

Use of Website


Your use of the website at www.nzlvgou.com (Website) creates a legally binding contract between you and NZLVGOU subject to these terms and conditions.

These terms and conditions incorporate any of the information or terms set out on pages on the Website linked to in these terms and conditions.

While NZLVGOU endeavours to ensure that no viruses or malicious software is contained on the Website, NZLVGOU makes no warranty as to your use of the Website and NZLVGOU will have no liability for any damage to your computer or other hardware as a result of your use of the Website.

You may not make use of any logo or trade mark displayed on the Website without the express written consent of NZLVGOU. You may link to the Website from any other website provided that you agree to immediately remove that link if requested by NZLVGOU.

Links to 3rd Party Websites


The Website contains links to website’s that are not controlled by NZLVGOU (Third Party Website). NZLVGOU makes no promises or warranties as to the content or security of any Third Party Website that you link to and use. Browsing any such Third Party Website will be at your own risk.

Terms of Sale


Orders cancellation and products refund/returns should be in accordance with NZLVGOU's return and cancellation policy.

All prices for products on the Website are GST included.

NZLVGOU endeavours to deliver all orders made by you on the Website but reserves the right to refuse to deliver any products ordered for any reason, including without limitation, unavailability of stock or a decision by NZLVGOU to no longer sell a product.

Payment Method and Processing Times


We currently accept 5 types of payment method which including Payment Express, Credit Card, Alipay, Weixin Pay, and E-wallet Pay.

Payments will not be processed until all applicable information has been received. If your payment is not received within 30mins that you receive your order confirmation, the system will automatically close the transaction. NZLVGOU also reserves the right to change prices for products displayed on www.nzlvgou.com at any time without notification.

Delivery


NZLVGOU will make every attempt to dispatch your item as soon as possible. It may however take up to 2 working days from date of payment for your item to be dispatched. Please note items will not be dispatched until payment has been received in full.

NZLVGOU makes every effort to deliver your product according to the estimated delivery times provided at checkout, however bears no liability for delays caused by Courier companies. All estimated delivery times are in business days and exclude weekends and/or public holidays.

Store Credit


Any credit awarded to the customer may only be used towards the payment of products listed on our website. Credit may only be used in accordance with the terms and conditions listed on the website. For normal, silver, gold and VIP customers, credit awarded can not be redeemable for cash. For SVIP user, NZLVGOU charges NZD $10 for cashing out each time.

If return is required, the item(s) must be returned to us with all internal and external packaging, accessories, swing tags, labels and manuals. The item(s) must be complete and intact under the warranty provisions.

If the product cannot be repaired or exchanged for a same or similar item, a full refund (including shipping) will be provided.

Warranties


All products ordered by you are supplied on an "as is, where is” basis and NZLVGOU makes no warranty as to the suitability or efficacy of any product beyond any manufacturer warranty included with the product.

No information on the Website is intended to be taken as medical advice and is intended only for information purposes. Always read the label of any product carefully and use only as directed. If your symptoms persist or you are uncertain as to whether any product may be safe for your use, consult a health professional. If you have a pre-existing medical condition, are pregnant or lactating, consult a health professional prior to using any product.

Liability


Subject to your rights under the Consumer Guarantees Act 1993, NZLVGOU will not be liable for any:

Warranties, conditions and representations whether express, implied, statutory or otherwise, relating in any way to the Website, your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through the Website; and

Liability (including for negligence) to you or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage), costs and expenses suffered by you or claims made against you arising from or in connection with your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through this Website for any reason whatsoever (including negligence). NZLVGOU’s maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount paid by you to NZLVGOU in respect of the product excluding any amount paid for delivery.

You agree that if any product has been acquired for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 are excluded in relation to those products.

Privacy


We protect all personal information you make available to us in accordance with our privacy and security policy.

User Submitted Content, including Product Reviews and Testimonials


We reserve the right to use all user submitted content we receive in our marketing and promotional material, both on and offline, identifying the submitter by first name only. If you don't want us to use your submitted content, please let us know.

Your submission of any such content confirms that you understand that this content may be used in a public context, either online and/or offline, and that NZLVGOU specifically may use, modify, edit or republish any such content submitted. While we endeavour not to significantly alter the meaning and intent of submitted content, we do sometimes edit it to condense, summarize, improve readability or comply with our regulatory obligations, and reserve the right to do so.

Beyond prevailing legislation, NZLVGOU has no obligation to screen or edit any content supplied by customers, but has the right to do so, and to modify, delete, refuse to post or remove any content, in whole or in part, from any portion of NZLVGOU’s websites or social media platforms, at its sole discretion for any reason, including, but not limited to, content that violates these terms and conditions or is otherwise objectionable.

You may not be permitted to edit or delete any content you have submitted, but can ask us for it to be removed from online publication, and we will remove it so long as it is reasonably practicable for us to do so.

Governing Law


The use of the Website and the ordering of any product by you from NZLVGOU is subject to the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the courts of New Zealand in relation to any dispute between you and NZLVGOU.


Freight & Delivery


You can expect your order to arrive quickly and in great condition.

We offer Fastway delivery within New Zealand on all orders. For delivery within Auckland, the cost is $5 NZD, rest of NZ, the cost is $8 NZD.

We offer Qexpress delivery for the orders delivered to China. Charge will be free for delivery to China and once the package is ready we will offer you the tracking number for you online.

Other international orders are welcome and we offer you a few choices for the delivery, please contact us before you place the order.

All Courier Post orders are sent with 'Track & Trace'. We'll send you a dispatch email with your tracking number after your parcel is processed and dispatched.

We accept responsibility for parcels lost in transit prior to their having been delivered to your home/business. We cannot accept responsibility for your parcel once delivery has been made.

We accept full responsibility for breakages in transit. If you experience a breakage please hold onto the item and packaging and notify us of the situation.

We know you'll often be ordering things you need in a hurry. If we have the products you order in stock - and we usually do - we'll dispatch your order within 1-2 working days. Occasionally a product which you order may be out of stock. In this case we'll contact you promptly with an ETA. If you are in Auckland, you can now also shop with us in person at our shop in Mangere and get advice from our in-store staff.

You can expect to receive your goods within 3 working days of having placed your order. We use Fastway for all national deliveries in NZ.

We send non-signature unless otherwise requested. If you're not at home when they call, and they deem it safe to do so, the driver will typically leave your parcel either at your door or close by. If they don't think it safe to leave, they'll leave a card to call.

If delivery is to a business you must include the business name in your delivery address. PO Boxes and Rural Delivery addresses are not a problem - feel free.


Return & Refunds


Your complete satisfaction is our ultimate goal. We will gladly refund or exchange purchased items under the following conditions:

In New Zealand and Australia all goods must be returned within 14 days of receipt.

In the rest of the world all goods must be returned within 28 days of receipt.

We will refund faulty or damaged goods. We will not refund for damage caused by the customer.

Used cosmetics, sexual products, food, and clothing are non-returnable and non-refundable.

Postage and delivery costs are non-refundable for all exchanges except for damaged goods.

All goods to be exchanged must be returned as new (i.e. new, unopened, unused, and in resalable condition).

We'll also provide free return shipping if your return is the result of our error such as damaged, defective, or incorrect items. In other cases, a return postage fee will apply and a 10% re-stocking fee will be applied on all returns.

Once your return has been received, a credit or refund will be issued within 30 days and an e-mail confirmation will be sent. Refunds will be issued in the original form of payment.

Non-Returnable or refundable products


All products listed as clearance items (with a short product expiry).

A product with a clear statement displayed on its page as non-refundable for your health and safety protection.

Lost products caused by improper delivery due to incorrect addresses and postcodes provided by the customer. Our address labels are automatic and any error in the input of delivery address is the customer's responsibility.

Prohibited items that are detained or confiscated at your own customs. Please check your country's customs and duty laws before purchasing.

Stock Unavailability


In the case you place an order for product that subsequently becomes unavailable or there is a delay in delivery, we will contact you via email and phone within 24-48 hours to advise you of the situation and the options available to you. You may wait until the product is available or replace the product with a substitute product (the order total will be confirmed and adjusted), unless otherwise instructed.

In other case where you would like to purchase a clearly stated the out of stock situation product, you may email us and we will contact you immediately once it becomes available again.
